IMPORTANT NOTICE

THIS SHORT-TERM RENTAL AGREEMENT (“Agreement”) IS A LEGALLY BINDING CONTRACT BETWEEN THE BOOKING GUEST (“Guest,” “Booking Party,” OR “You”) AND INNDOORSY™ (“Inndoorsy,” “Company,” “Host,” “We,” “Us,” OR “Our”), ACTING AS A PROPERTY HOSTING, BOOKING, AND COMMUNICATIONS FACILITATOR FOR INDIVIDUAL PROPERTY OWNERS.

By completing a reservation, making payment, accessing the property, checking into the property, or permitting any occupant or invitee to enter the property, Guest agrees to all terms and conditions contained herein.

This Agreement applies to all direct bookings made through:

• Inndoorsy.com

• Direct invoicing

• Third-party booking software

• Email or manual reservations

• Any affiliated direct booking portal operated by Inndoorsy®

1. PARTIES & PROPERTY

This Agreement is entered into between the Booking Guest and Inndoorsy®, acting on behalf of the individual property owner of the reserved property (“Property”).

The Booking Guest acknowledges that:

1. Inndoorsy® is not the owner of the Property unless otherwise specifically disclosed.

2. Inndoorsy® acts as a booking facilitator, communications manager, hospitality coordinator, and short-term rental operator on behalf of owners.

3. The Property may be privately owned.

4. Guest assumes full responsibility for their own actions and the actions of all occupants, visitors, invitees, pets, vendors, contractors, or any person entering the Property during the reservation.

2. AGE REQUIREMENTS

The Booking Guest must be at least twenty-five (25) years old unless otherwise approved in writing by Inndoorsy®.

Government-issued identification may be required at any time prior to or during the reservation.

Providing false information regarding age, identity, occupancy, or reservation details constitutes grounds for immediate cancellation without refund.

3. PAYMENT TERMS

All reservations must be paid in full according to the payment schedule provided at booking.

Guest authorizes Inndoorsy® to:

• Charge the payment method on file for all reservation charges;

• Collect security deposits;

• Charge for damages, excessive cleaning, smoking, rule violations, unauthorized occupancy, missing items, fines, or losses;

• Charge for any additional fees incurred during or after the stay.

Guest agrees that damage claims and additional charges may be assessed after checkout once the Property has been inspected.

4. SECURITY DEPOSITS & DAMAGE AUTHORIZATION

Guest authorizes Inndoorsy® to charge the payment method on file for any damage, misuse, excessive wear, missing items, rule violations, smoking remediation, fines, repairs, or other losses caused directly or indirectly by Guest or any occupant.

Charges may include but are not limited to:

• Furniture replacement;

• Mattress replacement;

• Appliance repair or replacement;

• Plumbing damage;

• HVAC damage;

• Flooring damage;

• Linen replacement;

• Excessive trash removal;

• Smoke remediation;

• Pet-related damage;

• Fire damage;

• Water damage;

• Unauthorized event damages;

• Excessive cleaning;

• Exterior damage;

• Landscaping damage;

• Hot tub misuse;

• Odor remediation;

• Loss of revenue due to repairs or downtime.

Guest agrees to fully reimburse Inndoorsy® and/or the property owner for all damages and associated costs.

5. SMOKING POLICY

NO SMOKING OR VAPING IS PERMITTED INSIDE THE PROPERTY.

This includes:

• Cigarettes

• Cigars

• Pipes

• Marijuana

• THC products

• Vapes/e-cigarettes

• Hookahs

• Any smoke-producing substance

Violation of the smoking policy will result in:

• An immediate minimum fee of $500.00;

• Additional remediation costs if damages exceed $500;

• Possible immediate termination of the reservation without refund.

Guest is responsible for all smoke-related damages including but not limited to:

• Odor remediation;

• Ozone treatment;

• HVAC cleaning;

• Upholstery cleaning;

• Linen replacement;

• Furniture replacement;

• Lost revenue from reservation downtime.

6. LINENS, TOWELS, & PROPERTY ITEMS

All linens, towels, bedding, furnishings, kitchenware, electronics, décor, and household items are the property of the owner and/or Inndoorsy®.

Guests agree that:

• Excessively stained, damaged, burned, ruined, or unusable linens/towels may be replaced at Guest expense;

• Makeup stains, spray tan stains, bleach damage, bodily fluid damage, burns, paint, oils, grease, or misuse beyond normal residential use may result in replacement charges;

• Missing items will be charged at replacement value plus applicable labor or shipping costs.

7. USE OF PROPERTY

The Property shall be used solely for lawful short-term residential lodging purposes.

Guest agrees NOT to:

• Host parties or events without written approval;

• Exceed occupancy limits;

• Use the Property for commercial filming or illegal activity;

• Disturb neighbors;

• Tamper with security devices;

• Move furniture excessively;

• Disable smoke detectors or safety systems;

• Use fireworks;

• Discharge firearms;

• Use generators or hazardous equipment;

• Damage landscaping or exterior features.

Quiet hours may apply and must be respected.

Guest is responsible for all fines, citations, HOA penalties, municipal violations, towing charges, or legal claims arising from Guest conduct.

8. FIRE, WATER, APPLIANCE, & NEGLIGENCE LIABILITY

Guest assumes full responsibility for any damage caused by negligence, misuse, or improper operation of the Property or its systems.

This includes but is not limited to:

• Leaving gas appliances or stoves on;

• Leaving water running;

• Overflowing sinks, tubs, or toilets;

• Misusing fireplaces or fire pits;

• Improper charcoal or grill use;

• Candle damage;

• Flooding;

• Fire damage;

• Electrical misuse;

• Damage caused by pets or children;

• Damage caused by unauthorized guests;

• Failure to secure doors/windows;

• Frozen pipes caused by negligence.

Guest shall be financially responsible for all resulting damage, remediation, restoration, insurance deductibles, business interruption, relocation costs, and loss of rental income.

9. HOT TUB, POOL, WATER FEATURE, & OUTDOOR AMENITY LIABILITY WAIVER

USE OF HOT TUBS, POOLS, CREEKS, PONDS, WATER FEATURES, FIRE PITS, DECKS, STAIRS, HIKING AREAS, SWINGS, HAMMOCKS, AND ALL PROPERTY AMENITIES IS ENTIRELY AT GUEST’S OWN RISK.

Guest acknowledges and agrees that:

1. Inndoorsy® and the property owner make no guarantees regarding safety or suitability of any amenity;

2. Hot tubs and water amenities may contain inherent risks;

3. Slips, falls, drowning, overheating, allergic reactions, infections, folliculitis, illness, or injury may occur;

4. Children under eighteen (18) must be supervised by a responsible adult at all times;

5. No child may use a hot tub unattended;

6. No diving is permitted;

7. Pregnant individuals or persons with medical conditions should consult a physician before use;

8. Alcohol use around hot tubs, pools, decks, or fire features increases risk of injury.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUEST HEREBY RELEASES, WAIVES, DISCHARGES, AND HOLDS HARMLESS INNDOORSY™, PROPERTY OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, MEMBERS, AGENTS, AND REPRESENTATIVES FROM ANY AND ALL CLAIMS, DAMAGES, LOSSES, INJURIES, ILLNESSES, DEATH, LIABILITIES, OR EXPENSES ARISING OUT OF OR RELATED TO USE OF THE PROPERTY OR ITS AMENITIES.

This waiver specifically includes:

• Hot tub injuries;

• Folliculitis;

• Skin irritation;

• Chemical exposure;

• Burns;

• Slips and falls;

• Wildlife encounters;

• Outdoor injuries;

• Water-related injuries;

• Alcohol-related injuries.

10. PET POLICY

Only approved pets are permitted where applicable.

Guest is fully responsible for:

• Pet behavior;

• Pet waste cleanup;

• Flea treatment costs;

• Odor remediation;

• Scratches or damage;

• Excessive shedding cleanup;

• Furniture damage;

• Yard damage;

• Injuries caused by pets.

Unauthorized pets may result in immediate removal and additional fees.

11. ENTRY & ACCESS

Inndoorsy®, the owner, maintenance personnel, cleaners, contractors, or emergency responders may enter the Property when reasonably necessary for:

• Emergencies;

• Safety concerns;

• Maintenance;

• Inspections;

• Rule enforcement;

• Repairs;

• Suspected violations.

Guest agrees not to deny reasonable access.

12. SECURITY CAMERAS & NO EXPECTATION OF PRIVACY OUTDOORS

Certain properties may utilize exterior security cameras, noise monitoring devices, or smart home systems.

No cameras shall be placed inside private living areas or bedrooms.

Guest acknowledges that:

• Exterior areas may be monitored;

• Tampering with devices is prohibited;

• Devices may be used to verify occupancy, unauthorized events, smoking, or security concerns.

13. MAINTENANCE & REFUNDS

Inndoorsy® cannot guarantee against:

• Weather;

• Utility outages;

• Internet interruptions;

• Appliance failures;

• Wildlife encounters;

• Road conditions;

• Construction nearby;

• Temporary amenity outages;

• Hot tub downtime;

• Power outages;

• Acts of God.

While reasonable efforts will be made to address issues, refunds are not guaranteed.

No refunds shall be issued for:

• Weather;

• Personal preference;

• Fear of wildlife;

• Insects common to rural areas;

• Temporary outages;

• Internet speed;

• Third-party service interruptions;

• Early departures.

Any refund, discount, or compensation is entirely at the sole discretion of Inndoorsy®.

14. ASSUMPTION OF RISK

Guest understands that short-term rentals, cabins, rural properties, forest properties, mountain properties, and outdoor-focused accommodations may involve inherent risks.

Potential risks include but are not limited to:

• Uneven terrain;

• Wildlife;

• Insects;

• Falling branches;

• Ice/snow;

• Rural roads;

• Hiking hazards;

• Water hazards;

• Fire hazards;

• Remote emergency response times.

Guest voluntarily assumes all risks associated with occupancy and use of the Property.

15. INDEMNIFICATION

Guest agrees to defend, indemnify, and hold harmless Inndoorsy®, Warford Hospitality Co. LLC, property owners, affiliates, employees, contractors, agents, members, and representatives from and against any and all claims, liabilities, damages, losses, suits, fines, penalties, costs, attorney fees, or expenses arising from:

• Guest occupancy;

• Guest conduct;

• Violations of this Agreement;

• Injury or death;

• Property damage;

• Actions of invitees or occupants;

• Violations of laws or ordinances;

• Amenity usage;

• Pet incidents.

This indemnification obligation survives checkout and termination of the reservation.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

1. Inndoorsy® shall not be liable for indirect, consequential, incidental, punitive, or special damages.

2. Inndoorsy® shall not be liable for lost items, theft, personal injury, illness, death, travel disruptions, cancellations, weather events, acts of God, utility failures, or third-party actions.

3. Any liability of Inndoorsy® shall be strictly limited to the amount actually paid for the reservation.

4. Guest waives any claim exceeding the reservation amount.

17. PERSONAL PROPERTY

Guests are solely responsible for personal belongings.

Inndoorsy® and property owners are not responsible for:

• Lost items;

• Theft;

• Damage to personal property;

• Vehicles;

• Trailers;

• Recreational equipment.

Items left behind may be discarded, donated, or returned at Guest expense.

18. CANCELLATION POLICY

The cancellation policy presented at booking shall control the reservation.

Travel insurance is strongly encouraged.

No refunds shall be guaranteed for:

• Weather;

• Illness;

• Travel interruptions;

• Road conditions;

• Personal emergencies;

• Natural disasters;

• Government restrictions;

• Wildlife concerns.

19. ILLEGAL ACTIVITY

Illegal activity of any kind is strictly prohibited.

This includes:

• Drug use;

• Human trafficking;

• Underage drinking;

• Weapons violations;

• Property destruction;

• Theft;

• Unauthorized parties.

Violations may result in immediate eviction without refund and referral to law enforcement.

20. DEFAULT & EVICTION

Violation of this Agreement may result in:

• Immediate termination of the reservation;

• Removal from the Property;

• Additional charges;

• Loss of deposits;

• Legal action.

No refund shall be owed in the event of removal for violations.

21. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the Commonwealth of Kentucky.

Any dispute arising from this Agreement shall be brought exclusively in Kentucky.

Guest agrees to personal jurisdiction in Kentucky.

22. SEVERABILITY

If any provision of this Agreement is determined unenforceable, the remaining provisions shall remain in full force and effect.

23. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes any prior discussions, representations, or understandings.

24. ELECTRONIC ACCEPTANCE

By booking, paying, checking in, accessing the Property, or allowing any occupant to enter the Property, Guest electronically acknowledges and agrees to all terms of this Agreement.

Guest further acknowledges that they:

• Have read this Agreement;

• Understand this Agreement;

• Agree to all rules, waivers, releases, and liability limitations;

• Accept full financial responsibility for damages and violations.
